Counter-Notification Process
If your material was removed or access disabled due to a copyright notice, you may submit a counter-notification. This allows you to dispute the claim of infringement. We will consider the counter-notification once it is submitted.
Required Elements for a Counter-Notification:
- Identification of the specific material removed or disabled. State the URL(s) where the material appeared before its removal.
- Your name, address, and telephone number.
- A statement that you consent to the jurisdiction of the federal district court. This jurisdiction applies to the judicial district in which your address is located (or, if your address is outside the U.S., any judicial district where topauarchitects.com may be found).
- A statement that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
- A statement, under penalty of perjury, that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification of the material.
- Your physical or electronic signature.
Send counter-notifications to our designated DMCA agent. We will forward valid counter-notifications to the original complainant. The removed material may be restored after 10-14 business days, unless the complainant files a court action seeking an order against the provider of the content.
Repeat Infringer Policy
TOP Australian Architects maintains a policy of terminating accounts of users who repeatedly infringe copyright. This policy applies to any user who uploads or submits content to our site, including architectural plans, images, or project descriptions.
We reserve the right to remove content and terminate user accounts at our discretion. Repeated violations of our intellectual property policies will lead to account suspension or termination.
